According to the petition, Ruby has studied in a private school till class V but her parents now could not afford to have her continue there so they applied to the nearby government school.

'The school denied admission to Ruby despite the endorsement by the education officer of the area and wrote no transfer certificate attached, which is not applicable in case of Ruby as she used to study privately before,' Ashok Aggarwal, counsel for Ruby, submitted.

He added it was really unfortunate that Ruby had to run from one authority to another for grant of admission in the academic year 2009-10 but without any success.
